PIP Claims After NY Auto Accidents – No-Fault Insurance

Both New York and Pennsylvania are no-fault states. This means that after a car accident, you are eligible for PIP (personal injury protection) benefits regardless of fault. It does not matter who caused the accident. If you are injured, you can make a PIP claim under an applicable car insurance policy.

In New York car accident cases occurring in the Binghamton and Ithaca area, PIP coverage is usually provided to you by the auto insurance company of the car that you were driving, a passenger in or hit by.

For example, a Binghamton resident is injured in a car accident while driving to work in Ithaca. The car accident was caused by a driver who ran a red light. The Binghamton resident sustains serious injuries and needs to make a PIP claim. The PIP claim would be made under the car insurance policy covering their vehicle, not the at-fault driver’s insurance policy.

PIP insurance covers economic losses you sustain in a car accident in NY:

  • medical expenses for treatment for the injuries,
  • lost wages as a result of your inability to work due to the injuries, and
  • other reasonable expenses, such as transportation to and from medical treatment and household help.

PIP Insurance Does Not Cover Pain & Suffering

PIP insurance coverage does not provide compensation for pain and suffering from injuries sustained in a car accident, nor does it provide coverage for property damage. Also, PIP insurance is not available to all injured parties; for example, motorcyclists do not receive PIP coverage. Read more about motorcycle accident compensation.

It is important to speak with a car accident lawyer to see whether PIP insurance applies to you based on your specific circumstances.

How to Make PIP Insurance Claims in the Binghamton & Ithaca Area

  1. If you sustain injuries in a car accident in NY, contact the car insurance company of the vehicle that you were driving, a passenger in or hit by and request a PIP application.
  2. You must complete the PIP application and return it to the car insurance company. You will also be assigned an adjustor from the insurance company that will handle your PIP claim.
  3. Once your application is received and approved by the car insurance company, you will be provided a claim number to give to your medical care providers so they can submit their medical bills for payment to the insurance company.

NY PIP Benefits – What’s the Benefit Maximum?

In New York, PIP coverage limits will vary depending on the applicable car insurance policy. Some policies provide for additional PIP coverage above the policy limits, called additional personal injury protection coverage.  Therefore, please confirm the available limits with the automobile insurance company providing your coverage.

Remember, medical bills for auto accident injuries will not be paid by no-fault insurance until the no-fault application is properly completed and returned to the car insurance carrier.
