Construction in the Age of COVID-19
Pursuant to updated guidance on New York Executive Order 202.6, all “non-essential” construction must safely shut down.
Essential construction may proceed, to the extent that it is:
- for infrastructure, healthcare facilities, homeless shelters, or schools;
- for affordable housing;
- necessary to protect the health and safety of occupants of a structure;
- necessary to continue a project if allowing the project to remain undone would be unsafe – but, construction must be shut down when safe to do so;
- for projects in the energy industry;
- for existing projects of an essential business;
- being completed by a single worker who is the sole employee/worker at the job site.
Personnel at essential construction sites must maintain appropriate social distance at all times. Sites that cannot maintain appropriate social distancing and cleaning protocols must close. Those in violation may be subject to fines of up to $10,000 per violation.
